Please read these Terms and Conditions carefully before using the Bharosa Hospitals
mobile application. By using this App, you agree to these terms.
1. Acceptance of Terms
By downloading, installing, or using the Bharosa Hospitals mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Bharosa Neuro Psychiatry Hospitals ("we," "us," or "our") regarding your use of the App.
2. Description of Service
The Bharosa Hospitals App provides a platform for mental health support services, including:
- Anonymous chat support for mental health concerns
- AI-powered chat for informational guidance (powered by OpenAI)
- Voice consultation services with healthcare professionals (powered by Agora)
- Video consultation services with healthcare professionals (powered by Agora)
- Secure OTP-based authentication (powered by Twilio)
- Payment processing for consultation fees (powered by Razorpay)
- Access to mental health resources and information
Important: AI-powered chat provides informational and supportive guidance only and does not offer medical diagnosis or treatment. Users are directed to qualified professionals for consultation.

3. Eligibility
To use this App, you must:
- Be at least 18 years of age, or have parental/guardian consent if under 18
- Have a valid phone number for OTP verification
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the App under applicable laws
- Provide accurate and complete information during registration
4. User Account
4.1 Account Creation
Account creation requires phone number verification via OTP (sent through Twilio). You are responsible for:
- Providing accurate, current, and complete registration information
- Maintaining access to your registered phone number
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
4.2 Anonymous Usage
Certain features, such as anonymous chat support, may be used without creating an account. Even in anonymous mode, users must comply with these Terms.
5. Payment Terms
5.1 Consultation Fees
Consultation fees for voice and video sessions with healthcare professionals are charged through Razorpay. Fees are:
- Displayed clearly before booking a consultation
- Charged at the time of booking confirmation
- Subject to applicable taxes as per Indian law
- Processed securely through Razorpay's PCI-compliant platform
5.2 Payment Methods
We accept payment methods supported by Razorpay, including:
- Credit and Debit Cards
- UPI (Unified Payments Interface)
- Net Banking
- Digital Wallets
5.3 Billing
You will receive a receipt via email for each transaction. All fees are in Indian Rupees (INR) unless otherwise specified.

6. Acceptable Use
When using the App, you agree NOT to:
- Use the App for any unlawful purpose or in violation of any laws
- Impersonate any person or entity or misrepresent your affiliation
- Harass, abuse, threaten, or intimidate other users or healthcare professionals
- Share false, misleading, or harmful information
- Attempt to manipulate or misuse the AI chat feature
- Attempt to gain unauthorized access to the App or its systems
- Use automated systems or software to extract data from the App
- Interfere with the proper functioning of the App
- Upload viruses, malware, or other harmful code
- Use the App to advertise or promote products or services
- Share content that is offensive, defamatory, or violates third-party rights
- Record consultations without explicit consent from all parties
7. Healthcare Services
7.1 Nature of Services
The healthcare professionals accessible through our App are independent practitioners. We facilitate connections between users and professionals but do not provide medical services directly.
7.2 AI Chat Limitations
The AI-powered chat feature (powered by OpenAI) is designed for informational and supportive guidance only. It does NOT provide medical diagnosis, treatment recommendations, or crisis intervention. Users should consult qualified professionals for medical advice.
7.3 No Emergency Services
The App is NOT intended for medical emergencies. If you are experiencing a medical emergency, mental health crisis, or thoughts of self-harm, please contact emergency services (112 in India) or go to your nearest emergency room immediately.
7.4 Professional Relationship
Any relationship formed with healthcare professionals through the App is between you and the professional. We are not responsible for the quality, accuracy, or outcomes of consultations.
8. Third-Party Services
Our App integrates with the following third-party services, each governed by their own terms of service:
- Twilio: For OTP authentication services
- Agora: For voice and video consultation infrastructure
- Razorpay: For payment processing
- OpenAI: For AI-powered chat functionality
By using our App, you also agree to comply with the terms of these third-party services.
9. Intellectual Property
The App, including its design, features, content, and underlying technology, is owned by Bharosa Neuro Psychiatry Hospitals and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
You may NOT:
- Copy, modify, or distribute the App or its content
- Reverse engineer, decompile, or disassemble the App
- Remove or alter any proprietary notices or labels
- Use our trademarks, logos, or branding without permission
10. User Content
You retain ownership of content you submit through the App. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process such content as necessary to provide our services.
You are solely responsible for the content you submit and represent that you have the right to share such content.
11. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information, including data shared with our third-party service providers (Twilio, Agora, Razorpay, OpenAI). By using the App, you consent to our data practices as described in the Privacy Policy.
12. Disclaimers
12.1 Service Availability
The App is provided "as is" and "as available." We do not guarantee that the App will be uninterrupted, error-free, or free from viruses or other harmful components.
12.2 Medical Disclaimer
The App, including the AI chat feature, does not provide medical diagnosis or treatment. Information and support provided through the App are not substitutes for professional medical advice. Please see our Medical Disclaimer for full details.
12.3 Third-Party Services
We are not responsible for the availability, reliability, or performance of third-party services (Twilio, Agora, Razorpay, OpenAI). Issues with these services may affect App functionality.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Bharosa Neuro Psychiatry Hospitals and its officers, directors, employees, and agents shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, data, use, or goodwill
- Any damages resulting from your use or inability to use the App
- Any conduct or content of any third party on the App
- Any unauthorized access to or alteration of your data
- Any reliance on AI chat responses or information provided through the App
- Payment processing issues handled by Razorpay
Our total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless Bharosa Neuro Psychiatry Hospitals and its affiliates from any claims, damages, losses, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit through the App
15. Termination
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination:
- Your license to use the App will cease immediately
- We may delete your account and associated data (see our Data Deletion Policy)
- Provisions that should survive termination will remain in effect
- Any pending refunds will be processed according to our Refund Policy
16. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the modified Terms.
17. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in India.
18. Dispute Resolution
Before initiating any formal legal proceedings, you agree to contact us first to attempt to resolve any dispute informally. If we cannot resolve the dispute within 30 days, either party may proceed with formal legal action.
19. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy, Medical Disclaimer, Data Deletion Policy, and Refund Policy, constitute the entire agreement between you and Bharosa Neuro Psychiatry Hospitals regarding your use of the App.
